Bob Barr's name is on the ballot

Since the Republican Party and Democratic Party have missed the Aug. 26 deadline to file to have their presidential candidates on the Texas ballot in this November's general election, Bob Barr will be the only name on it for us to vote for.

Of course, this heartens us Libertarians who have fought so hard for ballot access and for easier ballot access for all others, but we are continually beaten in this effort by the Republican Party of Texas' efforts. The Democratic Party of Texas has been much kinder to us all.

We have earned this place on the Texas ballot by our honest and legal filings and observance of Texas state law. Further shenanigans by the Republicans concerning this situation will be met with legal challenges and revelation of their tactics. The state law concerning this filing for the November ballot is clear.

I'm proud to be a supporter of Bob Barr for president -- the only real conservative candidate.

Editors's note: The Republican and Democratic presidential nominees will be on the ballot. The state party chairs filed paperwork before the deadline and will file amended papers after each of the respective conventions, according to the Texas Secretary of State's office.

Pretty good ones, evidently! *LOL* They clouded his mind so much he actually wrote this letter thinking he had facts to back up his absurd claims.

Now he'll be known as Fred "Oops" Jones.

Both the Republicans and the Democrats missed the deadline because their nominating conventions did not choose and certify candidates in time.
Of course, Obamma was the "presumed" Democrat nominee.
Of course McCain was the "presumed" Republican nominee.

But neither would be the official nominee until their respective conventions made them so.

The Democratic Convention certified Obamma a day after the deadline in Texas, so he missed the filling deadline.

The Republican Convention certified McCain more than a week after the Texas deadline, and near a week after Texas officials placed McCain's name on the official list.

The Secretary of State's office has virtually shown that they can put ANYONE'S name on the list ANYTIME they want, without waiting for it to become official.

This is a breach of law, and should be prosecuted. To place the name of a late filer on the official list is to do away with the deadline. The Dem who missed the filling date to run against Susan King was not treated in the same lenient manner. He should contact the SOS about having his name put on the list.

One more thing about the race for State Rep. Until the Dem candidate is sucessful in getting his name on the ballot, Libertarian Michael Walton is King's only opponent. Dems, to vote for the Libertarian in this race is NOT a wasted vote, but you have to go farther down the ballot than just the "Straight Democratic" box.

So you think 6 websites (5 of which are directly associated with the libertarian party) that all cut & pasted Barr's press release to their pages are legitimate proof of the facts?

So if I could find 6 goofball websites to cut & paste a post I write saying Steve Kirby wears a moose costume to bed, eats bugs covered in mustard and reads from right to left, that would make it true?

Y'all are really, really reaching now.

The truth is that Section 192.031 of the Texas election code spells out the requirements to be listed on the ballot in Texas for President and Vice President. It says that political parties must certify their presidential and vice-presidential candidates for the November ballot no later than 70 days before the general election. “A political party is entitled to have the names of its nominees for president and vice-president placed on the ballot if before 5 p.m. of the 70th day before presidential election day, the party’s state chair signs and delivers to the secretary of state a written certification of the name’s of the party’s nominees for president and vice-president.” That deadline was August 26.
This year, neither the Democratic Party nor the Republican Party obeyed this law.

At 2:30 pm Texas time, August 27, Kim Kizer of the Texas Secretary of State’s elections division reported that neither major party’s certification had been received in the Elections Division.
Regardless of whether the sites cut-and-pasted Barr's news release, the Law exists, and should be followed.

"Texas law also says that ballot-qualified parties are supposed to certify the names of their presidential and vice-presidential tickets by August 26. The Democratic and Republican Parties missed this deadline, but on August 29, the Texas Secretary of State added their nominees to its web page anyway. Authority for the Texas leniency comes from two 1996 Texas Supreme Court decisions, Davis v Taylor and Bird v Rothstein. Those decisions say that when a party official makes a paperwork mistake, the candidates should not be punished for that mistake and must still be considered qualified."

The "paerwork mistake" was not a mistake, but a delay caused by the National Conventions scheduling. Both National parties knew of the deadline. Both ignored it.
There will be lawsuits filed, and I hope the deadline is upheld in these cases just as it is in others.
