Former Jim Ned educator turns self in on improper relationship charges

A former Jim Ned teacher spent less than half an hour in jail Friday after turning himself in to authorities just after 5 p.m. on charges of having inappropriate relationships with students.

Kaleb Tierce, 26, faces one charge of having an improper relationship between an educator and a student and two counts of attempted improper relationships with students, according to Sgt. John Cummins of the Taylor County Sheriff's Office. Bail for each charge was set at $10,000.

The alleged relationships with female students began on school grounds, but the incidents are thought to have occurred off campus, Cummins said. The sheriff's office has previously said the incidents happened more than two years ago.

Cummins declined to elaborate on the incidents, but an improper relationship between an educator and a student is defined in Texas law as sexual contact or communication that is sexual in nature. It is a second-degree felony punishable by two to 20 years in prison and up to a $10,000 fine.

The Taylor County grand jury returned three sealed indictments Thursday. District attorney James Eidson didn't respond to inquiries Friday seeking comment.

Tierce taught pre-advanced placement English and was an assistant football coach at Jim Ned High School in Tuscola until he was placed on paid administrative leave in October 2007 after parents of a ninth-grader filed a complaint with the sheriff's office. The parents complained about Tierce assigning "Child of God," by Cormac McCarthy, to their then 14-year-old daughter. The book has graphic depictions of sex and violence.

The investigation was later expanded to include allegations of an inappropriate relationship between Tierce and at least one former student.

Tierce wasn't charged with providing harmful material to a minor, a misdemeanor. Eidson previously told the Reporter-News that his office could file the case with the county court at law without presenting evidence to a grand jury, which typically examines felony cases. The grand jury could be asked to determine if the book is offensive by community standards, he said in December.

In March, the Jim Ned school district trustees voted not to renew Tierce's teaching contract for the 2008-09 school year.

Repeated phone calls seeking comment from Kent Lefevre, superintendent of the Jim Ned Consolidated Independent School District, were not returned Friday.

Tierce's Texas educator certificate on the State Board for Educator Certification's Web site says he is under review by the SBEC Professional Discipline Unit. The review is standard when an educator is being investigated by law enforcement for alleged criminal conduct and could result in the state board revoking the teacher's certification.

Tierce is self-employed, Cummins said, and makes money by doing odd jobs.

I hope he gets to live out his favorite Cormac McCarthy story in prison! What do his supporters have to say now about their beloved teacher?

This is another reason for the rising popularity of home schooling, when you read almost every day about school teachers having "adult" relationships with their students.

Send him away, make sure he never teaches again and hopefully he will end up swinging upside down from the prison cell bars one night.

gary_p_your comment shows just how stupid you are(and you can't fix that). I certainly hope you home school your kids, they probably wouldn't fit in out in the public. What amazes me is that anyone would want to teach, especially a man. When any spiteful, ignorant teenage girl who doesn't get her way can point her finger and totally ruin the lives of so many! I agree that if he's guilty they should stick it to him, but let all the evidence be heard. I've heard some of this could have been made up/exagerated by the girl(s) and that some of the parents really fanned the flame to make it more than it was, if it was. If the book one girl read was on the list approved by all the english teachers, did any of them read it ever, and if not why is he catching all the flack? Was this girl assigned this book, or did she pick the book out of a free to pick list of books? There's a lot of questions that need to be answered here. Like I said, if he's guilty then throw his butt in jail - amen! But on the other hand, if he's not guilty, what's is to be done for these girls who possibly falsely accused him - would there be any consequence for that - or could kids say/accuse any teacher of anything without any consequences? Let the evidence be heard on both sides and justice be served.

At the risk of inciting a riot, I am reminded of Ken Starr's investigation of then President Clinton. When the Whitewater investigation turned up nothing the investigation kept broadening until they could attempt to hang something on him.

A second example that comes to mind is the Salem Witch Hunt.

I have no dog in this hunt. If Tierce is guilty, he should be punished. But the way the investigation was conducted, originating from bogus charges about a book from a list approved by the school, and the reported relationship between the alleged victims and officials in the community taints the investigation and allegations.

As an educator, I have seen the gamut of teachers being accused, teachers being exonerated, and teachers accepting a plea deal in order to avoid certain things...say, jail.
I don't understand why someone would jeopardize his/her career, family, good name, and reputation for a KID?
I have no idea if the man is guilty or innocent. I am just trying to wrap my mind around that thought process.
Are things that bad, that people cannot find adults their own age to "have relationships" with?
Is the self esteem so low, that they have to find someone that that can control?
Too many peoples lives are ruined by this kind of malarky.
The person accused, is forever tainted, the victim, (is there is one) has issues, and then the family. They are left behind to rationalize what happened.

Sad story all the way around. I agree with someone who earlier stated that something smelled fishy. The book was approved by the school board, but when a parent complained, it was removed?
Sounds like someone other than the teacher messed up here.

Is there anyone, anywhere, who still believes in Reaganomics? Ever since "VooDoo Economics" (--GHWB) appeared in 1981, we have seen one series of scams after another. First, the S&L Crisis of the 1980s, then the Leveraged Buyouts of the 1990s, and now the Free-Market Meltdown of the 2010s. We are witnessing the utter destruction for our free enterprise system by the false gods of deregulation, led by Phil Gramm and Newt Gingrich. When Reagan spoke of "trickle" down effect, we had no idea just how tiny the trickle would be. Now we do. It is now 30 years overdue to re-regulate the finance markets. Put rational limits on banks, credit card carriers, brokers, and exchange markets. It's pretty clear which party would bring sanity to our economic policies and which would continue driving us to the poor house.

He chose to accept the decision of the grand jury and turn himself in. That part sounds pretty law abiding. But it should be the jury who decides guilt or innocence based on the evidence. You know: innocent until proven guilty.

I don't see anywhere where he admitted anything. It says he turned himself in on charges. Were the charges filed first and after notification, he turned himself in? Again as stated earlier, lets get all the facts first. He still could be innocent until proven guilty..oh wait, that's the way it's supposed to work right?

Turning oneself in is not an admission of guilt. It is the only appropriate response when an indictment is issued.

The article fails to mention two important facts. First, these charges were brought in 2005. They received a full investigation by the Sheriff's department at that time, and there was no evidence of wrongdoing. Life went on. The charges were resurrected only after the department embarrassed itself with its inflammatory reaction to the McCarthy book issue. (Correction to the article: the girl was NOT assigned 'Child of God;' She chose it, having read the book jacket.)

Second, it has been a full year since these old charges were dug up. In that year, the Sheriff's department again failed to find enough evidence to bring charges, so it was handed off to the DA. The DA has been sitting on this case since December 2007. Does that sound like a reasonable way to handle someone you acutally believe to be a dangerous predator? No, it does not.

This is a witch hunt, and it's gone on long enough. Let this man and his family move on!

The SEALED indictment was handed down on Thursday. Mr Tierce's lawyer was not even allowed to know what the charges were until Friday. The Sheriff's office went looking for Mr. Tierce WITH THE MEDIA to arrest him at 5pm on FRIDAY...hoping to force this young man to spend a weekend in jail. Tierce turned himself in, found out what the charges were, posted bond and went home to his wife.

Taylor County is a Kangaroo Court. The DA's office is corrupt, the Sheriff's office is friends with the Highway Patrolman father of the girl who voluntarily PICKED "Child of God". All of these "law enforcement"...and I use that term loosely... people have banded together to ruin this young man. It took them a solid year to put together a case because there was not evidence. The charges from two years ago were investigated by a Juvenile Investigator then and found without merit. The charge of ATTEMPED inappropriate relationships with students is all they could come up with. The community should be asking why the DA's office has handled this case in the manner they have.

I would like to know how they decide to pursue a case also ! I took evidence of fraud and forged documents from the District clerks office and Judge Hackers signature on both documents and both stamped at the excact time and date by the district clerks office yet the documents are different ! The time and dates have been tampered with and altered on other court documents,when I take this evidence to every agency that is supposed to investigate and protect this system they refuse ,when i ask to see Judge Hacker for an explanation I am told to leave . Somehow they even have my signature on the false documents,Ms. Henderson ,of the District Clerks office ,reply to my questions was every now and then someone slips a document passed the Judge ? , and I should have caught it sooner it is to late now to do anything about it !who are these people ? what right do they have and who else has this been done to ? I left Abilon because of the under the rug type thriller cases only ,but e-z kill no brainers of course ! I have requested evidence from most of the agencies involved and they have refused to release and even denied the excistance of evidence .Man , I am glad i was not a teacher GOD only knows what they would have done to me then !!!!!!!!!

These are the people who should be facing charges:

-parents who only hear their kids' side of the story, and never stop to hear others. (Look at those who are involved, and you'll see a pattern.)

-the original investigator who rushed to judgment before even meeting with the witnesses,
(Why were the other English teachers, the librarian, and the other teachers not interviewed until after the press conference?)

-the DA who didn't excuse himself from this case involving personal friends.

-the supt who did not stand up for his teacher.

By the same people we pay to protect us.sounds like this lawman is only looking for some satisfaction.I cant beleive we have these kind of people in law enforcment.I have alot of friends in this buisness and hope they will never do this. I read that book that's the cause of all this trouble. Frankly, it was a lousy book! It was, in fact, almost laughable. It was so easy to put it down and forget about it. Cormac McCarthy wrote another book, 'No Country for Old Men' which was made into a hit movie. Now, that was a book I would think twice about my kids reading, much less seeing, the actual movie. Wonder how many of these same kids saw this movie and how many parents objected to that? Just curious...

The fact that he turned himself does indicate some degree of guilt. However this young man hasn't had his day in court yet. This whole situation must play out in the proper way. He may well be guilty, I'd say turning yourself would be very damning. His attorney better seek a change of venue. No way this man can get a fair trial in the Abilene area. Sadly, if he is guilty, he won't be the first or last teacher to have an inappropriate relationship with a student. I remember a teacher marrying a student not more than a week after graduation. We had no idea they had a "thing" going and 40 years later, they are still married. However, it still doesn't excuse it.

Turning yourself in does not indicate ANY degree of guilt. It is merely a formality that if you know that the law is coming to get you with the media, then you avoid embarrasment for you and your family.

Don't be stupid people, if you know that law is looking for you and you have a good attorney. You avoid the media circus and do what he did. He spent about 30 minutes down there until he posted bond.

Okay, so I realize not all of you have ever been in the position of having a teacher come on to you or approach you such an unexpected manner, but when you are a kid, which is what all of the girls were, it's just too much for them to handle.

To let you understand something clearly, the "spiteful, ignorant teenage girl" tried to ignore the phone calls from the sheriff department and just go and let this drop off the face of the earth. she in no way turned to "point her finger" and "ruin the lives of so many" ... in fact, going through this legal process has a severe effect on a person. the fact that you have to get up in front of people you don't know and talk about such personal things is something that NO ONE would want to do. That would likely be why Tierce thought he could fight this, because he sure didn't think that a teenage girl would have the courage to stand up and say what happened to her. After such long avoidance of this, she decided to go ahead and answer the calls and he kept pushing to avoid it... which i can say anyone would do... but yes, he did turn himself in, because she talked. she didnt tuck her tail and run.

--- yes this is a hard concept to most people, but just remember how many "sex offenders" there are. to them, some with their own kids, its not a matter of jeopardizing their own lives... they just want what they want. But, i am not saying that Tierce is a pedophile, just that he was too young at that point in time (mind you this was a few years ago) to handle being around beautiful young girls. they were all too close to his own age for him not to take attention to their beauty.

---- well, the sheriff's department did have enough evidence. that would be why they had contacted all the girls involved with coach tierce. and yes it was multiple... some just verbal. once they were confident in their case they then sent it to the DA and let the DA decide if they had enough confidence in the case. and they clearly did. the grand jury also did. that would be why he was indicted. the DA has not been "sitting" on this case... he dragged this out. kept fighting, which is again... what anyone would do... but why when you have fought for so long would you suddenly turn yourself in? does that make any sense...?? just food for thought.
if you are innocent you would keep fighting.

no one thinks he is a "dangerous predator"... not even the student(s) affected by him. they just don't think its a good idea for him to continue teaching young girls.

for those of you who claim to know him and his accusers... just think about the fact lots of people can keep secrets... i'm sure you have some of your own. lots of people will think they know you too well to not know something about you, but in fact there is something that no one knows about you. whether it be in your past or something you hide from the present...
a person can seem like they would never do wrong, and still be doing wrong. i realize how many of you support Coach Tierce, and I don't think there is anything wrong with standing behind what you believe... I do not him. I do know enough about this case to say all these things though. and i know enough about human nature to accept the fact that attraction can overtake your morals. take for instance adultery... which is what he did. ... how many people do you know that have committed adultery? did you expect that from all of them?
come one people. the former student will always have to deal with the fact that when she was young and dumb she was in that inappropriate relationship. she still has to have her own kids and her own marriage... the amount of fear she will have of letting her kids go to school because she would not want this to happen to them... and i know none of you would be doubting this whole case if it was your daughter, niece, cousin, sister or friend.

i know that tierce is a great asset to the football aspect of Jim Ned, but is a great team worth the chance of him starting a new relationship with another student?

One thing is for certain. The little girl's life is forever damaged and she has a huge mental battle ahead of her. Her moving around from school to school and apparently has had a long list of problems. I pray for all involved and as far as I can see there are no winners here.

I happen to know these girls and none of them believe that he is a horrible person and none of them wish anything bad upon him... they just don't believe he is mature enough to handle teaching the beautiful teenage girls that are in high school now days. I happen to be very close to one of the girls and she is very upset about this whole thing. She doesn't want anything bad to happen to Coach Tierce, but she doesn't want to risk having another girl go through what she has. And just so you all know at first she didn't want a part in all of this! Hence the reason she ignored everyone trying to get in touch with her about it. She partially blamed herself.... But then she started to think about her friends little sisters and she didn't want them to deal with the feelings that she has to now. She also doesn't want another girl to have to deal with the hatred that most people are showing her. It took some serious guts for her to come forward and tell the truth but she isn't doing it to hurt Tierce, she is doing it to keep it from happening again. Can any of you answer this one question for me.... Why would she lie about this whole thing when she knows it will ruin her? You people keep pointing fingers saying she's a liar but none of you actually know anything. It breaks her heart to know that so many people hate her for doing the right thing. Why don't you guys try to get all the FACTS instead of just his story.

It maybe a formality, but it sounds like to me he is trying to mitigate any penalties at trial. I didn't say he was entirely guility, also if the authorities hada warran, I presume they did, then they should have a pretty good idea as to whether they have a case or not. It also maybe that some teenage girl who had the hots for this guy got her drawers in a wad because he did the proper thing and turned her advances down. Whatif, I disagree with you and I'm quite sure none of know what law enforcement does. I hope this deal comes out to everyones satisfaction, but I rather doubt it.

so teedoff, it would not matter who started this relationship because he is an adult... she was a kid.
she could have been laying in the nude waiting for him and he still should have turned his head and walked away. that however is not what happened. he did approach her, it was mutual but he still can't be defended about this... he was wrong for pursuing this relationship with a student.
and by the way you just agreed that he is guilty by saying that. you have made it clear that you know something about this whole thing... you know they had a relationship... you admit it

because if he had reported it then they would not have called him into the office for that...

Ifer how can you possibly know that ? Unless you're close to the family or related to these girls you couldn't know that. Anyway, this is an ugly situation which is bound to get worse. Sadly, its all too common and not reported as often as it might need to be. Also, some of the women teachers hit on the guys as well, can you say Mary Kay Latourneau ? Now there is a smarmball. We Texans love gossip and a good scandal. This certainly qualifies.

If you asked others at the school you would also know what i know.... i mean other's who care more about their students and faculty than the football teams great season.
by the way, i do not want to seem like i'm coming down on the football team either, but i do know that it is hard for a lot of people to allow themselves to believe it because of the fact that Tierce was a great coach.

and yes, females do this whole student/teacher relationship stuff too, and all those women who do get involved, just like the men, need to deal with some consequences.

I agree with whatif. I'm pretty sure an arrest warrant is automatic after a grand jury indictment. From experience, I can tell you the difference between being arrested and turning yourself in. When you're arrested you are cuffed and driven to jail. After the booking process you get your phone call. Most people call the bondsman and it might take hours for him to come get you out. Then you are pretty much on your own getting home or whereever else you want to go. Charlie Olson is a good guy and insists that he drive you home, however I suspect he may just want to physically see where you live. If you know there is a warrant for your arrest with a bail amount already set, you can contact the bondsman ahead of time. He will verify the charges, the bail amount and inform the authorities when you will turn yourself in and that he will post the bail at that time. They process you in and out at the same time. The whole process takes about thirty minutes and you leave in your own car.

Turning yourself in is in no way an admission of guilt and if you think so, you should be disqualified from ever serving on a jury. One other thing I can tell you though. I was guilty every single time I was arrested.

Mstiah, I'm right and you know it. Texans do love a juicy scandal and goosip. You undoubtedly don't remember when T. Cullen Davis went on trial for murder. That was 30 years ago and they are still taking about it. We humans, particularily Texans love goois and scandal. My God, hasn't Texas had more than their share ?

Since I will assume most of you people posting don't know him personally and just read smut and believe it I hope it doesn't come home to haunt you. These girls are lying and have been...why do you think it came up 3 years ago...nothing was found and now they are bringing it up. Until you know the people involved you need to keep an open mind. This man is a wonderful young man...these girls wanted attention didn't get it and now they are tearing this man and his family up. Rmemeber the old saying hell hath no fury like a woman (girls) scorned. They saw an opportunity to get at him again when the book thing came up and now they have taken it. I suggest all of you who don't know this man or these girls keep an open mind and pray for all the people involved.

I don't know if he is guilty or not. It wouldn't matter if I knew him, I still wouldn't know if he was guilty or not. There are thousands upon thousands of women who marry men that subsequently molest their daughters. Yeah, some of them were falsely accused, but some of them videotaped themselves too. I suspect that most of them thought they knew their husbands. Lots of them obviously didn't.

You know what the big problem is here? The big problem is that acknowledging that someone that we loved and trusted and respected may have done something like this makes it necessary for US to admit that WE may have been wrong.

So... how precisely do YOU know that he is NOT guilty mamad?
