Cop who killed Texas motorist not indicted

MORRISTOWN, N.J. -- A state grand jury in Morris County has decided not to indict a Denville police officer who shot a Texas man to death during a traffic stop.

The Morris County prosecutor's office says no indictment will be issued against Officer Richard Byrne.

The grand jury met for the past week to examine the shooting death of Ruben Martinez in June. Authorities have said Martinez was racing away from police in his vehicle, and Byrne was inside the car right before it sped off.

Byrne shot five times at close range.

Martinez lived in Laredo and was visiting New Jersey for his brother's high school graduation.

Denville Police Chief Christopher Wagner says he's relieved Byrne has been cleared. Wagner says Byrne hasn't returned to work because he needs surgery for a shoulder injury suffered in the incident.
